Oksjonil osalemine
Oksjonil osalemiseks tuleb pakkujatel end eelnevalt registreerida.
Oksjonile registeerimisel täidab pakkuja vastava registreerimise
vormi, milles ta kinnitab, et ta on tutvunud käesolevate
oksjonitingimustega ning kohustub neid täitma.
Oksjonile registreerumiseks on pakkuja kohustatud esitama
oksjonipidajale (viimase palvel) isikut tõendava dokumendi.
Oksjonile registreerumisel väljastab oksjonipidaja pakkujale kaardi,
millel on märgitud pakkuja number. Pakkuja on kohustatud jälgima, et
talle väljastatud numbriga ei teeks pakkumisi kolmandad isikud.
Pakkuja saab oksjonile registreeruda oksjonimajas kohapeal kuni
oksjoni alguseni, v.a. eelneva kirjaliku pakkumise ja
telefonipakkumise korral, millisel juhul saab oksjonile
registreeruda oksjonikorraldaja koduleheküljel internetis kuni üks
(1) päev enne oksjoni toimumist.
Oksjoni viib läbi oksjonipidaja.
Pakkumine
Pakkumisi võib teha pakkuja isiklikult kas oksjonisaalis, eelnevalt
kirjaliku pakkumisega või oksjoni ajal telefonipakkumisega. Kui
pakkujal ei ole võimalik teha pakkumist isiklikult ühelgi
ülalnimetatud viisil, võib pakkuja paluda oksjonipidajal teha
pakkumine enda eest.
Oksjonimaja ei vastuta telefoniühenduse kvaliteedi eest.
Pakkumine algab oksjoni kataloogis osutatud alghinnast.
Oksjonipidaja otsustab pakkumise sammu suuruse. Pakkuja, kes teeb
kõige kõrgema pakkumise loetakse eseme ostjaks. Oksjonipidaja poolt
kinnitatud lõplik ostuhind (haamrihind) on ostja jaoks siduv.
Oksjonipidajal on õigus vaidluste tekkimise korral otsustada eseme
müügi tühistamine või koheselt uue pakkumise korraldamine.
Oksjonimaja ei avalda eseme müüja nime selle ostjale ja vastupidi.
Asjaolude ilmnemisel, mis võivad takistada esemete müüki oksjonil,
võib oksjonipidaja oksjonilt maha võtta mistahes eseme või muuta
oksjonil müüdavate esemete järjekorda.
Ostuhind ja tasumise kord
Ostuhind on haamrihind, millele lisandub oksjonikorraldaja teenuse
tasu 15% (buyer's premium).
Oksjonil ostetud eseme eest tasumine toimub oksjonikorraldaja poolt
väljastatud arve alusel. Ostja kohustub tasuma ostuhinna hiljemalt
kolme (3) tööpäeva jooksul arvates oksjoni toimumisest kas
pangaülekandega või sularahas. Kõik ostuhinna tasumisega seonduvad
täiendavad kulud (sh. pangaülekande kulud) kannab ostja.
Ese
Pakkujal on õigus müügile pakutud ese enne oksjonit üle vaadata ning
selle seisukorraga tutvuda.
Eseme kirjeldused oksjoni kataloogis ning nende iseloomustus oksjoni
toimumise ajal on tehtud oksjonipidaja parima teadmise kohaselt.
Pakkumise teinud ostja kinnitab sellega, et ta on esemega tutvunud
ja on teadlik ostetava eseme seisukorrast. Tal ei ole õigus esitada
oksjonijärgselt oksjonikorraldaja vastu pretensioone.
Oksjonipidaja ei kanna vastutust oksjonil müüdavate esemete
autentsuse ega ekspertiisiaktide õigsuse eest.
Eseme äraviimine
Ostja kohustub korraldama ostetud eseme äraviimise oksjonimajast
seitsme (7) tööpäeva
jooksul pärast ostuhinna tasumist.
Juhul, kui ostetud eset ei ole ettenähtud aja jooksul ära viidud,
loetakse ostja ja oksjonikorraldaja vahel sõlmituks hoiuleping ning
ostja kohustub tasuma oksjonikorraldajale hoiutasu summas viissada
krooni (500 EEK) päevas, kui ei ole kokku lepitud teisiti.
Kõigi ostetud esemete äraviimisega seotud toimingute eest (sh.
pakkimine ja transport) vastutab ostja, v.a juhul kui ostja ja
oksjonipidaja on kokku leppinud teisiti. Ostetud asjade Eesti
Vabariigist väljaviimiseks vajalike lubade saamise eest vastutab
ostja.

Participation in auction
Bidders shall prior register to the auction in order to participate.
At the registration to the auction, the bidder shall complete a
respective registration form, in which he warrants that he has
examined these conditions of sale and shall obey them.
At the request of the auctioneer, the bidder should be able to
provide an identity document for registration to the auction.
Upon registration to the auction, the auctioneer shall provide the
bidder with a card, on which the bidder’s number is determined. The
bidder is obliged to observe that third persons do not make bids
with the number that is issued to him.
Bidder is entitled to register to the auction at the auction house
until the beginning of the auction, except in case of prior written
bids and phone bids, where it is possible to register at the
auctioneer’s homepage in the internet up to one (1) day prior to the
auction.
The auction shall be carried out by the auctioneer.
Bidding
Bids shall be made by the bidder in person either at the auction
hall, with prior written bid or by phone bid at the time of the
auction. If the bidder is unable to make a personal bid in none of
the ways mentioned above, the bidder may ask the auctioneer to make
the bid on his behalf.
The auction house shall not be responsible for the quality of the
phone connection.
Bidding shall commence from the base price indicated in the auction
catalogue.
The auctioneer shall decide the amount of the bid step. The bidder
who makes the highest bid shall be considered the purchaser of the
object. The final purchase price confirmed by the auctioneer (hammer
price) shall be binding to the purchaser. In case of disputes, the
auctioneer shall have a right to decide the annulment of the sale of
the object or organise a new bid.
The auction house shall not reveal the name of the seller of the
object to its purchaser and vice verse.
Upon appearance of circumstances, which may hinder the sale of
objects at the auction, the auctioneer shall be entitled to withdraw
any object from the auction or change the order of objects of sale
at the auction.
Purchase price and payment
The purchase price is the hammer price, to which the buyer’s premium
of 15% will be added.
Payment for the object purchased at the auction shall be made on the
basis of an invoice issued by the auctioneer. The purchaser shall
pay the purchase price for the purchased object within three (3)
working days as of the auction either by bank transfer or in cash.
All expenses related to the payment of purchase price (incl. bank
transfer expenses) shall be incurred by the purchaser.
Object
The bidder shall have a right to examine the object offered for sale
prior to the auction and access its condition.
Descriptions of the object in the auction catalogue and their
characterization at the auction are made to the best of the
auctioneer’s knowledge.
The purchaser who has made a bid warrants with it, that he has
examined the purchased object and is aware of its condition. He
shall have no right to present any claims against the auctioneer.
The auctioneer shall not bear responsibility for the authenticity of
the objects of sale at the auction nor for the authenticity of
expert’s reports.
Removal of the object
The purchaser shall be obliged to organise the removal of the
purchased object from the auction house premises within seven (7)
working days following the payment of the purchase price.
If the purchased object is not removed within the given period, a
deposit contract is considered to be concluded between the purchaser
and the auctioneer and the purchaser shall be obliged to pay to the
auctioneer a storage fee in the amount of five hundred kroons (EEK
500) per day, unless agreed otherwise.
All expenses for activities related to the removal of the purchased
object (incl. packing, transport) shall be paid by the purchaser
unless the purchaser and the auctioneer have agreed otherwise. The
purchaser is also responsible for getting the needed exporting
licenses for exporting the purchased object out of the
Estonian
Republic.
